NYS Wage Theft Protection Act
As a follow-up on our last Newsletter, we are finding more and more companies just don't know about the new - New York State Wage Theft Protection Act. Worse yet, they don't seem to be bothered that this new law and the way that the law will be used, THIS COULD COST YOUR COMPANY MONEY, as the State is going to use this Act for revenue generation.
To that end, we are enclosing both the NYS notice (P715), NYS FAQ and a SBA * Consulting note, which highlights where to find (and save everyone quite a bit of time, because it is done in a very confusing manner) all the myriad of forms that meet the requirement of the Act.
Another nice factoid is you can build your own form, as long as it contains the same data as the sample forms; tying it into a database. Payroll companies may or may not be providing these forms, but we still suggest you spread the word.
Note: All new hires since April 9th, 2011 require this form, as well as when a raise occurs. Also, ALL employees need to sign the form in January 2012 and then every anniversary of January.
New York State's Department of Labor is being sneaky - by not really informing companies in the State about the requirements and the stiff penalties (up to $2500 per employee, per year), besides a short blurb on their website, which not many businesses go to.
